According to the 1948 Universal Declaration of Human Rights (UDHR) of the United Nations, the right to healthcare is one of the inalienable human rights.

Article 25 of the declaration states: "Everyone has the right to a standard of living adequate for the health and well- being of himself and his family, including food, clothing, housing, medical care, and necessary social services.” Additionally, the 1966 International Covenant on Economic, Social, and Cultural Rights (CESCR) reinforces this in Article 12, stating: "State Parties recognize the right of everyone to the highest attainable standard of physical and mental health. "2 Meanwhile, the TRIPS Agreement of the World Trade Organization (WTO) sets high standards for intellectual property (IP) protection concerning pharmaceutical patents. This has led to conflicts between patent protection rights and access to medicines, especially in developing countries like Vietnam, where the healthcare system faces many limitations and people encounter economic barriers when accessing medication. The remarkable advancements in science and technology have opened unprecedented opportunities in medicine, helping to extend life expectancy and improve quality of life.

When a new pharmaceutical is developed, patents grant exclusive exploitation rights to the patent holder for about 20 years under standard regulations.

This system allows pharmaceutical companies to recover research and development costs while promoting innovation. However, in practice, many pharmaceutical companies have exploited patent rights to extend their monopoly through strategies such as secondary patents, minor modifications to drug formulations or dosage forms, without significant improvements in medical efficacy. As a result, drug prices are inflated, making them inaccessible to patients and straining healthcare systems, especially in low- and middle-income countries. International organizations such as the World Health Organization, the United Nations Development Programme, and the Drugs for Neglected Diseases Initiative have repeatedly called on nations to re-evaluate patent protection mechanisms in pharmaceuticals to ensure that access to medicine is not restricted by purely commercial interests.

Several flexible measures were introduced in the 2001 Doha Declaration on TRIPS and Public Health, allowing developing countries to: (1) Issue compulsory licenses to manufacture or import generic drugs in cases of urgent medical needs; (1) Engage in parallel importation from countries where the drug is available at a lower price; (11) Waive data exclusivity on clinical trial results when necessary. However, the implementation of these mechanisms remains challenging due to pressure from developed countries and major pharmaceutical corporations. In Vietnam, a developing country with a still-limited healthcare system, balancing patent protection and ensuring access to medicines has become a complex challenge. Epidemics, climate change, population aging, and rising healthcare costs have made this issue more urgent than ever.

Despite flexible policies in applying TRIPS regulations, drug prices in Vietnam remain high relative to average incomes. Generic drug imports from India and domestic pharmaceutical production still face technological and production capacity limitations. Meanwhile, the COVID-19 pandemic has exposed weaknesses in the global healthcare system, where some wealthy countries hoarded vaccines, while poorer nations struggled with supply shortages and higher costs. Finding a reasonable solution that protects intellectual property rights while ensuring that people have access to essential medicines at affordable prices has become a major challenge in Vietnam's healthcare policies.

For these reasons, research on the protection of intellectual property rights in pharmaceutical patents is not only urgent but also plays a critical role in shaping policies and ensuring healthcare equity for society as a whole. Thus, the author has chosen this topic for their thesis, titled: “Patent protection for pharmaceuticals in Vietnam- Theoretical and practical issues”. Domestic research studies *Among the domestic research studies related to this topic, one of the notable works is the Master’s thesis titled "Bảo hộ sáng chế liên quan đến dược phẩm theo quy định của Hiệp định TRIPS và pháp luật Việt Nam," conducted in 2012 at Hanoi Law University. This study reflects the author's dedication to the issue of balancing interests among different stakeholders.
