Đơn cử, Bộ luật Hình sự chưa quy định rõ về trách nhiệm của nhà cung cấp dịch vụ internet trong phòng chống tội phạm mạng. Ngoài ra, lực lượng chuyên trách an ninh mạng còn thiếu về số lượng và chuyên môn. Việc triển khai các biện pháp phòng ngừa chủ động cũng còn hạn chế.

III. Giải pháp nâng cao hiệu quả phòng chống tội phạm mạng xuyên quốc gia

Để nâng cao hiệu quả phòng chống tội phạm mạng xuyên quốc gia, Việt Nam cần hoàn thiện hệ thống pháp luật, tăng cường hợp tác quốc tế, và nâng cao năng lực chuyên môn. Trước tiên, cần sửa đổi Bộ luật Hình sự để bổ sung các tội danh cụ thể về tội phạm mạng xuyên quốc gia, tăng nặng chế tài đối với tội phạm có tổ chức. IV. Kết luận và khuyến nghị cho Việt Nam

Mặc dù đã có những tiến bộ trong xây dựng khung pháp lý, nhưng vẫn còn nhiều hạn chế trong thực thi. Để nâng cao hiệu quả phòng chống, Việt Nam cần hoàn thiện hệ thống pháp luật, tăng cường hợp tác quốc tế, và nâng cao năng lực chuyên môn. Các biện pháp này phải được triển khai đồng bộ và có sự tham gia của tất cả các bên liên quan. Việc học hỏi kinh nghiệm quốc tế và áp dụng các giải pháp phù hợp sẽ giúp Việt Nam đối phó hiệu quả hơn với tội phạm mạng xuyên quốc gia. Furthermore, the evolution of cyber threats has led to the emergence of advanced persistent threats (APTs), cyber espionage, and state-sponsored cyberattacks, which target sensitive government and corporate data.

These threats have the potential to destabilize economies, disrupt essential services, and compromise national security. Cybercriminals often exploit software vulnerabilities, human errors, and weak authentication protocols to infiltrate networks and systems. As cyber threats continue to evolve, there is an increasing need for governments and private sector entities to work collaboratively to enhance cybersecurity defenses. Cybercrime has emerged as a significant threat due to its ability to exploit the anonymity and borderless nature of cyberspace.

Criminal activities such as hacking, identity theft, financial fraud, cyberterrorism, and data breaches have become increasingly sophisticated. These crimes often involve perpetrators from multiple jurisdictions, making it challenging to track, apprehend, and prosecute offenders. The lack of harmonized international legal frameworks further complicates efforts to combat cybercrime, as differences in national laws, law enforcement capacities, and jurisdictional limitations hinder effective cooperation among states. The global impact of cybercrime is staggering.

In 2023, Cybersecurity Ventures reported that worldwide losses due to cyberattacks amounted to approximately $8 trillion USD, with projections suggesting this figure could surpass $20 trillion USD by 2026!. This equates to monthly losses of $667 billion USD, weekly losses of $154 billion USD, daily losses of $21.9 billion USD, hourly losses of $913 million USD, and per-minute losses of $15. vn/2024/06/tong-ket-ninh-mang-nam-2023-va-du-bao. Focusing on Vietnam, the nation has witnessed a significant rise in cyber incidents.

In 2024, the National Cyber Security Center (NCSC) recorded and addressed 4,029 cyberattack incidents within the first eight months, underscoring the pressing need for enhanced cybersecurity measures’. Additionally, a survey conducted by the National Cybersecurity Association (NCA) in December 2024, encompassing nearly 5,000 organizations, revealed that 46.15% of agencies and enterprises experienced at least one cyberattack during the year, with an estimated total of over 659,000 attacks?. Notably, critical sectors such as finance, oil, and postal services, including entities like VNDirect, PVOIL, and Vietnam Post, were targeted, highlighting the pervasive nature of cyber threats across various industries. These statistics underscore the escalating threat of cybercrime and the imperative for countries like Vietnam to fortify their legal and institutional frameworks.

By adopting international best practices and fostering cross-border collaboration, nations can enhance their resilience against the multifaceted challenges posed by cybercriminals. It can be observed that the provisions of the Criminal Code regarding cybercrime are increasingly being supplemented and improved. However, these provisions still have certain limitations and do not yet fully meet the requirements for combating crimes in this field, both in the present and in the future. In practice, various difficulties and obstacles continue to arise, requiring timely resolution to enhance the effectiveness of law enforcement efforts.

From a theoretical perspective, cybercrimes are relatively new, involving highly complex technical aspects. As a result, the number of research studies on these crimes remains limited, especially since the promulgation of the Criminal Code 2015. Similarly, Steven Malby or Robyn Mace, Anika Holterhof, Cameron Brown, Stefan Kascherus, and Eva Ignatuschtschenko assert that there is no universally accepted definition of cybercrime‘.

Instead, studies typically list specific offenses, such as unauthorized access, data destruction, computer fraud, and violations of privacy. Within Vietnam, cybercrimes have been the subject of numerous studies, including specialized monographs such as "Crimes in the Field of Information Technology" by Dr. Phạm Van Lợi and “Crimes in the Field of Postal and Telecommunications Services and Solutions for Prevention and Combat" by the Institute of Strategy and Science of Public Security. Master’s theses, such as those by MSc.

Tran Thi Hong Le” and MSc. Tran Thanh Thao, have also focused on analyzing the legal aspects of these crimes. Additionally, many research articles published in specialized journals by Nguyen Manh ToanŠ, Dang Trung Ha, and Nguyen Hoa Binh have explored the characteristics of cybercrime and proposed preventive measures. Additionally, the doctoral dissertation by Nguyen Quy Khuyen, Crimes in the Field of Information Technology and Telecommunications Networks under Vietnam’s Criminal Law, compares international regulations with the provisions on cybercrime in the Criminal Code 2015 and proposes solutions for legal improvements.

Based on the research status of and the research objectives of the dissertation, the issues that the dissertation continues to explore are reflected in the following aspects: the dissertation will study the theoretical and practical application of the provisions of the Criminal Law regarding cybercrimes. Through this analysis, it aims to propose solutions to enhance the effectiveness of these legal provisions in the future. Research objectives and tasks The objective of this research is to propose solutions to improve the legal framework, enhance law enforcement effectiveness, and contribute to the development of a comprehensive legal mechanism for combating cybercrime in Vietnam. The study aims to identify existing gaps and limitations in Vietnam’s Criminal Code regarding cybercrime. To achieve this objective, the study will focus on several key research tasks.

First, it will examine the theoretical foundations of cybercrime, including its nature, characteristics, and classification under international and Vietnamese law. Thereby, it will conduct a comparative analysis of international legal regulations, such as the Budapest Convention 2001 and other relevant legal instruments, to assess their applicability and relevance to Vietnam’s legal system. Moreover, the research will evaluate the practical challenges faced by law enforcement agencies in detecting, investigating, and prosecuting cybercrime cases. Finally, based on these findings, the study will propose recommendations for amending and supplementing Vietnam’s legal provisions on cybercrime, ensuring alignment with international legal standards while addressing domestic enforcement challenges.

Research subjects and scope 4. Research subjects This study focuses on cybercrime as a legal and criminological phenomenon, analyzing its characteristics, trends, and the challenges it poses for criminal law enforcement. Besides, the research examines how major international conventions and legal frameworks address cybercrime and other significant international regulations. Research scope The scope of the research primarily covers international legal standards on cybercrime and their implementation in Vietnamese jurisdictions.

A comparative legal analysis will be conducted to assess the strengths and weaknesses of foreign regulatory models and their applicability to Vietnam’s legal framework. The study particularly focuses on the Criminal Code of Vietnam, analyzing its provisions on cybercrime, identifying gaps and limitations, and proposing legislative amendments to ensure alignment with international legal norms while addressing the unique challenges of cybercrime enforcement in Vietnam. Additionally, the research considers practical enforcement issues. The findings aim to provide concrete recommendations for amending and supplementing Vietnam’s Criminal Code 2015, ensuring a more robust legal foundation for combating cybercrime in an era of rapid technological advancement.
