Conclusion 16 O Introduction Leaving to others the task of reviewing Viet Nam’s accomplishments in improving its response to juvenile crime and its treatment of juvenile offenders, I would like to draw your attention on some of the remaining challenges in developing a comprehensive, coherent and effective juvenile justice system.These challenges are not neglectable and they will require a sustained effort for years to come. These challenges, some have argued, include: ¢ Weak inter-agency coordination and collaboration (and the absence of a coordinating agency for juvenile justice) ° - The absence of a comprehensive juvenile justice law * Overlapping administrative and criminal systems * Continued over-reliance on child detention © Lack of specialisation amongst police, procuracy, justice, lawyers * Concept of informal measures (diversion)is still new and poorly understood; * Public pressure for harsher punishment ° Limited services for effective supervision, re-education and reintegration of juvenile offenders * Lack of trained, dedicated staff for7 community-based rehabilitation of juvenile offenders There is obviously a lot left to do and there remain several social, cultural and systemic barriers to successful and comprehensive juvenile justice reform.
However, Viet Nam is not the only country facing such issues and there is perhaps something to learn from the experience of other countries and how they addressed these challenges or barriers. The presentation covers five main areas: e Lessons learned about the implementation of juvenile justice reforms; e Obstacles frequently encountered in justice reforms; e The role of media representations and their impact on public perceptions and public attitude toward juvenile justice reforms; e Institutional resistance and obstruction to reforms;and, © e The need for data to monitor the implementation and impact of reforms. ImplementingJusticeReforms In many countries, the implementation of juvenile justice reforms has lingered or failed — because these reforms had not been systematically planned,communicated,or adequately resourced.Too often, the proclamation of a new law is treated as a final accomplishment, as opposed to merely a starting point.For instance, a resolution of the Parliamentary Assembly of the Council of Europe observed: “Moreover, despite the panoply of international and regional standards providing a well-established framework for modelling juvenile justice, there is a considerable and continuing dissonance between the rhetoric of human rights discourse and the reality of juvenile justice interventions, in particular juvenile detention, for many children. The United Nations and the Council of Europe’s monitoring bodies have identified a rather unsatisfactory situation with respect to the enforcement of human rights standards in the area of juvenile justice and detention.
In this context, the over-representation of vulnerable children in detention has been considered alarming” (Council of Europe, 2014: para 3). In fact, justice reforms often fail because of predictable implementation issues (Berman & Fox, 2016).Pierce Parker and Upin summarized the problem as follows: “Implementation is what makes or breaks reforms, and the challenges associated with implementation are many: the human, fiscal or technical resources may be inadequate for the task at hand; training and support may be lacking; the strategy or selected program’s goal is not a good fit for the need that exists; or the strategy or program is not implemented as it was designed and fails to achieve the anticipated outcomes. Ifthere is no way to monitor implementation progress and measure outcomes, there is no way to know if the implementation is effective(Pierce Parker &Upin, 2016). Implementation of Juvenile Justice Reforms in Canada A number of specific lessons can be drawn from the implementation in Canada of the Youth Criminal Justice Act, 2003 (YCJA).
There was initially a lot of opposition to the proposed changes in the law and their perceived emphasis on a crime control model.
