The necessity of study Inthe context of the strong development of the world economy, more and more new-generation free trade agreements are being established and implementing commitments at a deeper level, more diverse, and more transparent. However, in contrast to socio-economic development, humanity's living environment faces serious pollution and increasing degradation.
The economic development in recent times along has greatly negatively impacted the environment. This is not just a problem of a country or region but has become a global problem and there needs to be practical joint action from each country to solve this problem As a country heavily affected by climate change, Vietnam has special attention to efforts to respond to global climate change. On March 8, 2018, Vietnam and 10 countries officially signed the Comprehensive and Progressive Agreement for Trans- Pacific Partnership. The signing of CPTPP was a success for countries efforts after the United States withdrew from the Trans-Pacific Partnership (TPP).
The Agreement will take effect in Vietnam from January 14, 2019. Up to now, the CPTPP is one of the highest standard agreements with the most comprehensive and strict commitments that Vietnam has ever participated in. Therefore, the CPTPP is not only meant to create new growth power for the economy but is also considered a major “turing point" for Vietnam, bringing Vietnam to a new position in the process of international economic integration. Now, sustainable development is the goal that countries aim for.
Therefore, the strict commitm ent to the environment in the CPTPP Agreement shows the importance and special role of environm ental protection in today’s industrial economy. Therefore, it is important to leam and research more deeply about the environmental commitments in the CPTPP Agreement and the opportunities and challenges that Vietnam currently faces when implementing these obligations to find appropriate solutions, creating favorable conditions for economic and social development is essential. Based on the above explanations and reasons, I chose the topic “Environmental commitments in the Comprehensive and Progress Agreement for Trans — Pacific Partnership — Opportunities and challengesfor Iĩetmam ” as the topic of my graduation thesis. Based on analyzing environmental commitments in the tò CPTPP Agreement and comparing the level of environmental commitments in the CPTPP Agreement with environmental commitments in WTO Agreements and some other free trade agreements, I hope to point out the opportunities and challenges for Vietnam when implementing these commitments.
Along with that, we propose solutions for building Vietnamese laws compatible with international environmental commitments, ensuring the implementation of environmental commitments to towards the goal of Vietnam achieving Net Zero by 2050. The situation of research on the study Recognizing the importance of environmental protection in sustainable development, in the past few years, research on environmental commitments in the CPTPP Agreement has received much attention from many scientists followed by different aspects. However, the number of research projects that go deeper into analyzing environmental commitments of the CPTPP Agreement and opportunities and challenges for Vietnam when implementing this obligation is still quite limited. During the research process, I found some typical research projects as follows: First, in Vietnam, research projects on the environmental commitments of the CPTPP Agreement have not been mentioned much Some typical works can be mentioned as the work "Ministry of Industry and Trade (2021), The Comprehensive and Progressive Agreementfor Trans-Pacific Partmership - Commentsfrom insiders" The work has a large capacity and is considered to be the most practical, useful, and valuable reference book in the documents on the CPTPP Agreement in Vietnam up to the present time.
The work provides basic information and especially analysis, comments, and answers to frequently asked questions about the contents and commitments of the CPTPP Agreement in each field This is the only book that specifically analyzes the commitments of the CPTPP Agreement compiled by the Ministry of Industry and Trade to authorities, businesses, and citizens to have more information and basic perspectives clearly and accurately about the CPTPP Agreement. However, because this is a book that provides an overview of the CPTPP Agreement, the research, and analysis of environmental commitments are still not complete and detailed. But that does not mean we cannot recognize the useful contributions this work brings to the treasure of documents of the world in general and Vietnam in particular. The work has succeeded in analyzing in detail the content of environmental commitments in Chapter 20 of the Agreement, thereby analyzing the challenges in perfecting environmental protection institutions in Vietnam. Or a famous work is the Master's Thesis "Nguyen Quang Huy (2020), Environmental commitments in the Comprehensive and Progressive Agreement for Trans-Pacific Parmership (CPTPP) Opporhmities and challenges for Vietnam, Vietnam National University- The School of Law". The work analyzed in detail the environmental commitments in the CPTPP Agreement and pointed out opportunities and challenges for Vietnam when implementing this obligation. From there, the work also proposes some solutions to improve the legal framework in Vietnam Second, with foreign research works, the works are mainly monographs and research articles that provide an overview of the CPTPP Agreement and evaluate compatibility with national law.
Research on environmental commitments in the CPTPP Agreement is quite limited, mainly only a small part of public reports or articles published in the media, with almost no research articles specifically analyzing thisissue. In particular, the analysis of opportunities and challenges for Vietnam when implementing environmental obligations under the CPTPP Agreement has not received much attention and research from international experts. The work is an assessment and analysis from an economic perspective on the prospects for cleaner trade in Vietnam. Therefore, the implementation of environmental commitments in the CPTPP Agreement is extremely necessary. The work also devotes a small amount of space to mention that Vietnam needs to have appropriate solutions to effectively implement environmental commitments under the CPTPP Agreement. Another work is “Research and Information System for Developing Countries (2019), Emerging Issues on Trade and Sustainability".
The work has provided assessments of prospects and challenges for developing countries on the issue of sustainable development. At the same time, this study also points out environmental regulations in regional trade agreements. However, the analysis of environmental commitments in the CPTPP 4 Agreement is only limited to a general perspective and has not gone into an in-depth analysis of the advantages and disadvantages for the group of developing countries. Thus, based on the above research, I have provided arguments and examples to prove that the environmental commitments in the CPTPP Agreement are high-level commitments and important commitments in protecting the environment and promoting sustainable development.
